Q. 당사는 제조업을 하고 있는 법인입니다. 비어있는 창고를 화장실로 개조(신축)하여 사용하려고 합니다. 오수관 설치를 포함하여 화장실 관련 모든 항목을 새로 지을 계획이고 예상비용은 4천만원 정도입니다. 또한 기존 건축물 대장의 용도 변경 신청 예정입니다. 이러한 경우, 화장실을 구축하는데 드는 모든 비용을 과세표준으로 보아 취득세 신고를 하면 되는 것인지 궁금합니다.

A. 취득세 과세대상이 되는 기타 급ㆍ배수시설의 개수도 취득세 과세대상이 되는바, ‘시가표준액 조사ㆍ산정 업무요령’에 의하면 “기타 급ㆍ배수시설의 개수”란 해당 시설의 잔존 내용연수를 연장시키거나 그 가치를 현실적으로 증가시키는 수선(급ㆍ배수시설 길이의 3분의 1 이상을 수선하는 경우에 한함)을 말합니다(다만, 해당 시설물의 도장이나 급ㆍ배수시설의 작동에 필요한 기계ㆍ밸브의 소모된 부품교체, 기타 사용가능한 상태의 유지 등을 위한 수선은 제외).

급ㆍ배수시설 교체는 상기에 해당되는 경우 과세가 되는 것입니다.

그런데 조세심판원에서 건축물의 신축에 있어 배관 등의 설치비용을 건축물의 취득가격에 포함하는 이유는 배관 등이 그 자체로서 취득세 과세대상에 해당되기 때문이 아니라 해당 건축물이 정상적으로 기능하는데 없어서는 안 될 건축물의 일부이기 때문으로, 이와 같은 측면에서 본다면 건축물 내부에 있는 상ㆍ하수도 배관 등은 건축물의 필수 불가결한 시설일 뿐 지방세법 시행령 제5조 제1항 제5호에서 규정하고 있는 급수ㆍ배수시설에 해당되지 않는다고 보는 것이 합리적이라 할 것인바, 건축물을 대수선하는 경우가 아닌 유지ㆍ관리하는 차원에서 이를 교체하거나 수선하는 것은 지방세법 제6조 제6호 나목에서 규정한 개수에 해당되지 않는다고 보는 것이 타당하다고 판단된다(조심 2019지2003, 2019.6.26.)라고 결정하고 있습니다.

따라서 건물 내의 급ㆍ배수시설(오수관 포함)의 노후 배관 교체는 과세대상이 되지 아니할 것이나, 귀문처럼 비어있는 창고를 화장실로 개조(신축)하면서 배관 등을 추가 설치하는 경우 급ㆍ배수시설 설치로 보아 배관(배관관련 공사비 포함)만 과세대상이 되는 것으로 볼 여지가 있습니다만, 실무적으로 배관 금액(배관관련 공사비 포함)이 미미할 것이고 상기 조심결정례의 취지에 따라 신고를 하지 아니하는 것으로 알고 있습니다.
